Full Terms of Service

Please read the full terms of service before commissioning me.

General Terms

  • Artist has the right to refuse, refund, or decline any commission request for any reason.

  • Client must be 18 years or older to commission me.

  • Progress on the Art will start when Artist receives payment, no unpaid work will be done.

  • The Artist will only work with Clients who actively respond to messages, as the Artist needs close feedback from their Clients.

  • The Artist will not work with Clients who are rude, hateful, or harass the Artist. A clear verbal or written warning will be issued to the Clients about the unacceptable behavior. If the Client continues the behavior, the Artist has the right to block and report the Client for harmful behavior and no refunds will be issued.

1. Engagement

  • Client provides clear and complete requirements and expectations upfront, including reference materials or assets before starting to work on the Art.

  • Client warrants that the character design and reference material provided to the Artist are legally obtained and authorized for use by the Client.

  • Artist warrants that they will not copy or heavily reference unauthorized materials.

  • Artist reserves the right to refuse projects or requests based on content, subject, or other reasons. (For more information please see Section 2)

  • Artist defines scope of work, features, price, deliverables and other details for the project in a proposal in a format according to Artist discretion which may include private message through Discord or Fur Affinity, or email. The details set forth by the Artist shall be agreed upon by the Client before work begins.

2. Content Restrictions & Prohibited Behavior

  • Artist will not create content that is deemed hurtful, offensive, or inappropriate.

  • Specific artwork restrictions include but are not limited to: Extreme Adult Content, Gore, BDSM, Poo/Pee, Depictions of SA/Non-Con, and Depictions of underage characters in sexual situations.

  • Clients may not edit the Art after final delivery unless specified in the commission information, project outlines or otherwise approved by the Artist.

  • Editing, removing the watermark or claiming the Art is the Client's own work is strictly prohibited.

  • Clients are strictly prohibited from using the Art for any sort of AI, ML, Crypto, NFT usage or training.

3. Process

  1. Client Submits Commission Form (or contacts me if they need questions answered).

  2. Receives final quote from Artist and agrees to payment/payment plans.

  3. Pays PayPal invoice.

  4. Artist starts work on Art.

  5. Client receives updates on the Art every 1-3 weeks, and gets Clients approval before moving on to the next stage (Sketch, Inks, Color, Shading, Final Touches).

  6. After final payment, Client is given finished Art.

4. Timeline

  • Work completion requires 2 weeks minimum, and may take up to 7 months depending on each project.

  • Average timeline: Sketches: 1-2 weeks, Full Body: 2-3 months, Full Body Shaded with Background: 3-5 months, Comic Page: 3-6 months.

  • Timeline depends on commission type, complexity, and current workload.

  • Artist provides progress updates and actively will seek out Client feedback.

  • Once Artist has started on the Art, the Client will be sent screenshots of the Art in progress, every 1-3 weeks. The Client is more than welcome to reach out to the Artist for an update, as long as they are respectful of the Artist's time.

  • Final deliverables are provided by the Artist using email, Google Drive, Discord or similar file transfer tools, in a PNG format or other formats as applicable. Any files hosted by the Artist will be available for the Client to download until the end of time.

  • If there are any delays and adjustments to timeline, the Artist will inform the Client.

  • Clients must understand and agree that potential delays outside of the Artist's control may occur (sickness, injuries, major life events, etc.) that could delay the commission. The Artist will notify to the Client if circumstances arise that may otherwise alter the average timeline to deliver a commission. If for some reason the Artist cannot notify the Clients, a post on Twitter, FA, or Bluesky will be made about the delays.

5. Refunds and Revisions

  • No refunds are possible after work begins unless initiated by the Artist or if Artist cannot complete work for unforeseen reasons (such as major illness, injury, adverse life event, or death) the Client may be eligible for a full refund. If progress was done on the Art, the Artist will provide a partial refund according to the amount of work complete.

  • Unlimited revisions are allowed per item shown to the Client during the sketch process.

  • After approval of the final sketch, additional charges for major revisions may be required and would cost 15-25 USD for each major revision depending on how extensive. This includes but is not limited to redrawing of limbs, expressions, body parts, ect.

  • Minor revisions such as changing hair color, minor adjustments to the drawing, adding more fur, ect. are free.

  • Revisions may affect progress and timeline.

  • Clients may not edit the Art after final delivery unless specified in the commission information, project outlines or otherwise approved by the Artist.

  • Editing or removing the watermark of the Art is strictly prohibited.

6. Communication

  • Ongoing communication and discussion will occur throughout the project, including work in progress, idea generation and collaboration, situational updates, and more.

  • Communication channels may include Discord, Fur Affinity Notes, or email, according to Artist discretion.

  • Artist response time may vary, up to one week in order to provide better updates. If the Artist has not responded in that time, the Client is more than welcome to ask for an update.

  • The Artist and Client agree to discuss relevant matters concerning the project. Both parties have the right to decline other topics of discussion.

7. Rights and Usage

Artist General Rights

  • By default, Artist retains copyright, ownership, redistribution and intellectual property rights, which includes but is not limited to display, advertising, printing, the Art and work in progress on websites, social media, portfolios, public broadcast channels (i.e. Twitch or YouTube) and more.

  • The Artist retains the non exclusive rights to sell merchandise and prints of their Work, unless exclusive commercial rights are purchased by the Client.

Client Rights for Personal Use Licensed Works

  • Clients receive non-transferable usage rights to the Art for personal use.

  • Personal use means: Display on social media accounts for promotional purposes with no direct monetization or sales, such as social media profile pictures, banners, and posts; print and framing in personal spaces; display as part of designs on websites and channels, excluding use in content of these websites or channels; or any other instances where no monetization of, or of content featuring, the Art is involved.

  • Client shall not claim Art as their own and must credit Artist using their username or link when displaying the Art or permanently on their websites, social media profiles, broadcast channels and so on where possible.

Client Rights for Commercial Use Licensed Works

  • Commercial usage rights are not included in general commissions, unless they are purchased by the Client and agreed upon, typically 2x of the original cost. If the Client needs commercial rights please message the Artist.

  • Commercial rights may differ for each commission type. Commercial broadcast rights means usage of Art on videos, advertisements and other content, or any similar monetized instances; Commercial distribution rights means selling or reselling Art to another party, as a part of any product or merchandising, or on another platform.

  • Any usage of the Art for AI (artificial intelligence) or ML (machine learning) tools, platforms or programs; AI or ML training; NFT; blockchain; crypto or other for-profit platforms/purposes, is strictly prohibited.

8. Payment

  • Clients can either pay for Art in full or request the total amount as split payments. Payment can be broken up anywhere from 2-5 installments.

  • For Clients using payment plans, the amount of installments requested will determine how far along the process the Artist will work on the Art. The typical stages to a commission are as follows: Sketch, Inking, Flat Colors, Shading, Final Touches/Edits.

  • After payment is made, the Artist will start work on the Art, no unpaid work will be done.

  • Invoices, proposal or payment link will be sent to the Client when Artist is ready to begin work. Clients must not send money before these requests for payment from the Artist.

  • Invoices must be paid within 72 hours (3 full days), or the project may be cancelled.

  • Prices are in USD and paid via PayPal invoice only.

  • Final prices may vary or change depending on complexity, requirements and/or additional requests.

  • Once Art has begun or payments have been made, the Client acknowledges Art and deliverables are digital and there are no physically shipped goods to receive.

  • Client agrees that they will not issue chargebacks and the refund policy mentioned above will be followed.

9. Confidentiality

  • The Artist and Client acknowledges that information and materials that are provided to either party (including but not limited to: personal information, technical information, marketing plans, payment information, or sensitive business information) outside of the development of the Art, that will not be visible to the public, shall be considered confidential information and shall not be disclosed to any other party without prior written permission from the owner of this confidential information.

  • If the Client wishes the Art and any information about it remain private (ie: not posted or streamed publicly), please contact the Artist directly via Discord, Fur Affinity notes or email for more information.

10. Acceptance

  • Client is 18+ years old and legally able to commit to an agreement.

  • Agreement date is upon first inquiry/communication or first PayPal transaction. Upon submitting a commission form request, the Client agrees to the Terms of Service.

Frequently Asked Questions (FAQ)

1. How often will I get an update on my commission?
Once I have started to work on the art, I will try to send you an update every 1-3 weeks. Message me on Discord if you want an update! :)

2. Can you draw this character from this TV show/comic book/anime?
Yes I can draw characters from cartoons, comics, anime, ect. as well as try to match art styles.

3. Could I upgrade a commission I got in the past from you?
Yes! The cost of the upgrade would simply be the cost of the new art minus the cost for the art you already paid for. For example a $30 sketch upgraded to $100 shaded art would mean you only have to pay $70.

4. Do I have to pay the total cost of the commission up front? What about half?
No, you do not have to pay all of the cost upfront! I will discuss with you about how much each partial payment would cost and then send you a PayPal invoice for the total amount (easier to track how much is left), but the invoice would have partial payments allowed, so you only have to pay the agreed upon amount. Normally I break up the total cost of a large commission into 4-5 partial payments, for example a $300 total commission would only be 4 payments of $75.
